Yes, sports betting is legal in Delaware. In 1992, the Professional and Amateur Sports Protection Act (PASPA), also known as the Bradley Act, was passed. It effectively outlawed sports betting nationwide by prohibiting states from regulating or licensing sports betting. However, four states, Delaware, Nevada, Montana, and Oregon, could continue offering limited forms of sports betting.
In 2018, the Supreme Court struck PASPA down in the landmark Murphy vs National Collegiate Athletic Association (NCAA). In a 6-3 decision, the Supreme Court ruled PASPA unconstitutional under the Tenth Amendment.
While Delaware already had limited forms of sports betting, the PASPA ruling allowed the state to expand its offerings significantly. Three weeks after the verdict, DE began offering full-scale, legalized sports betting at Delaware Park, Dover Downs, and Harrington Raceway.
Despite these changes, online sports betting is still limited in the state. Only BetRivers is officially allowed to offer its app. However, Delaware residents continue to use the many US-friendly betting sites based offshore.
