Well, possibly, although you have to remember that the priority for the state is bringing gamblers to Nevada to gamble rather than to provide online games to its own population, which is rather small. People come to Las Vegas to visit casinos, not to gamble online.

Meanwhile, the locals’ casinos that do cater to state residents don’t want people sitting around gambling at home when they could be at a casino.

Nevada is unique in that its economy is so heavily tied to the gambling and entertainment industries, and these are fiercely protected by the legislature. Nevada actually has a public policy of fostering “the stability and success of gaming” and there have always been fears that online casinos would cannibalize the gaming industry – although there’s plenty of research out there that says they don’t.

It’s the same reason there’s no lottery in Nevada, which is something that surprises people. If it’s gambling, and it doesn’t take place in a casino, they don’t want it.

I think there’s also a sense that there’s so much gambling already out there, and so much tax revenue coming from it, that online casinos become harder to justify. Many other states have regulated online casinos because they want to raise revenues without raising taxes. But Nevada already has gambling revenues and low taxes, so it doesn’t hold water.

It’s a very good question. I think regulating online poker was seen as less of a risk for the casinos, and so it was an experiment worth taking. Land-based poker isn’t a big revenue-generator for the industry. It was always seen as a way of attracting visitors who may stay to play other games.

Meanwhile, online poker introduces the game to people who otherwise wouldn’t have played it in a casino and soon they develop an interest in playing live. The jury’s out on whether online casinos would have the same impact in Nevada. Meanwhile, land-based casinos can market their services to their online poker players, so there’s a positive trade off.

In the case of sports betting, there was a sense that – well, lots of states are going to do this, so we’d better get our skates on. Remember, the striking down of PASPA was generally good for the big casino operators like MGM and Caesars, who get to offer sports betting at their casinos and via mobile apps in other states. This offsets a potential dip in retail betting in Nevada, at least for the bigger players. But the transformation of Las Vegas into a pro sports destination over the last five or so years means there is still a lot of retail betting going on.

If Nevada’s casino industry wanted online casinos, it would almost definitely happen. For many years, LVS chairman and CEO Sheldon Adelson was adamant that there would be no casinos on his watch, but since his death in 2021, there have been no efforts to introduce them. So there’s a sense that the casino industry is still not sold on the idea.

If it were to happen, you would almost certainly see in-person registration, as is currently the case with sports betting. They’d want you to turn up at the brick-and-mortar version at least once! You would also expect the biggest operators on the Strip to dominate the market.

And that’s another reason why it might never happen — and it swings back to the cannibalization argument. It’s arguable that these few dominant players would be generating online casino revenues that would otherwise be going to smaller land-based casinos in the state. That may be something the legislature is not willing to accept.
