Section 65 of the Alabama Consitution says, “The legislature shall have no power to authorize lotteries or gift enterprises for any purposes, and shall pass laws to prohibit the sale of lottery or gift enterprise tickets in this state.”

Some amendments have been made to the AL Constitution to allow charitable bingo games in specific counties. These have usually been passed after referendums, but they’re strictly controlled.

State statutes and laws also shape Alabama’s gambling laws. The Code of Alabama Chapter 12 prohibits promoting and even participating in gambling, which explains why Alabama sports betting tends to occur offshore. However, these state laws allow pari-mutuel wagering on horse and dog racing in specific locations.

A couple of federal laws also play a role in shaping the legality of gambling in Alabama. The Indian Gaming Regulatory Act (IRGA) allows the Poarch Band of Creek Indians to operate three tribal casinos on their lands, but they do not offer sports betting. The Unlawful Internet Gambling Enforcement Act (UIGEA) makes it illegal to knowingly accept payment for online gambling activities, going at it from the angle of banking methods, again incentivizing Alabama betting revenue to flow to the offshore operators.

So, is sports betting legal in Alabama? No, but it remains widely available at dozens of gambling sites based in the Caribbean, Panama, and elsewhere.
